By purchasing or using our dedicated server hosting services for Euro Truck Simulator 2 (ETS2) and American Truck Simulator (ATS), you agree to the following Terms and Conditions.

1. Service Scope

1.1 We provide dedicated server hosting infrastructure only, which includes computing resources, storage, and network connectivity.
1.2 Our service runs the official dedicated server package offered on Steam by the game developer (SCS Software). We do not modify or customize the server software beyond the standard setup.
1.3 All server configurations and management are handled exclusively through our web panel. Customers do not have direct access to the server files, console, or system-level configurations.
1.4 We do not provide, modify, or distribute any additional game-related content, including but not limited to game files, mods, plugins, or third-party software.

2. Payments and Subscriptions

2.1 Payments for the hosting service are processed through FastSpring. Any disputes, billing issues, or support requests related to payments must be directed to FastSpring customer support, as we do not manage the payment process directly.
2.2 The service operates on a monthly subscription model with automatic renewal unless canceled by the customer before the renewal date.
2.3 If the subscription expires or is not renewed, all servers associated with the account will be permanently deleted, and no data recovery will be possible.

3. Responsibility for Content and Usage

3.1 The customer is solely responsible for all configurations, settings, and content running on their server within the limits of the web panel.
3.2 Any help, support, or troubleshooting related to the official ETS2 and ATS dedicated server program must be requested directly from SCS Software via their forums or official support channels. We do not provide technical assistance related to the dedicated server software itself.
3.3 We do not monitor, regulate, or moderate content uploaded to or running on the server. Any liability arising from the use of unauthorized, illegal, or infringing content is the sole responsibility of the customer.
3.4 Customers must ensure that their server complies with the ETS2 and ATS end-user license agreements (EULA) and any third-party terms of use.

4. Server Updates and Compatibility

4.1 We do not control or influence the release of server updates to align with the current game version. Updates to the dedicated server software are managed exclusively by SCS Software, and they decide when to release new versions.
4.2 SCS Software may update the game before releasing an update to the dedicated server software, causing temporary incompatibility between the game and the server. We are not responsible for any downtime or issues caused by this delay.
4.3 The server configuration allows customers to select and run a previous version of the server software to maintain compatibility with an older game version. However, the availability of previous versions is entirely dependent on SCS Software, as they control what versions are available on Steam.
4.4 We do not guarantee that previous server versions will remain available or that they will function correctly with future game versions.

5. User Access and Management

5.1 The customer can grant access to other users for managing server configurations. However, we do not track, control, or manage user access permissions.
5.2 The customer is solely responsible for who has access to their server settings and for any actions performed by those with access.
5.3 We do not take responsibility for any changes, damage, or issues caused by users who have been granted access by the customer.

6. Mods and Custom Content

6.1 Customers may use modifications (mods) on their servers at their own risk. However, we are not responsible for issues caused by mods, including but not limited to:

  • Server crashes, instability, or performance issues.
  • Incompatibility with the dedicated server software.
  • Unexpected behavior affecting gameplay experience.

6.2 Excessive modifications, untested content, or scripts beyond what is provided by the game developer may negatively impact server performance, connectivity, or user experience. We assume no liability for such cases.
6.3 If a customer’s server is found to be causing performance degradation due to excessive modifications or scripts, we reserve the right to impose limitations or request adjustments to ensure service stability.

7. Infrastructure and Service Availability

7.1 Our hosting infrastructure is provided by DigitalOcean. We do not have direct control over their maintenance schedules, network stability, or any other service interruptions that may temporarily put servers offline.
7.2 While we strive to provide a stable hosting environment, we do not guarantee uninterrupted service. Downtime due to maintenance, technical failures, or external factors (such as DDoS attacks) is not our liability.
7.3 We do not take responsibility for unauthorized access, hacking, or security breaches caused by weak security practices or compromised user credentials.

8. Compliance with Laws and Game Developer Policies

8.1 The customer must ensure that their server usage complies with all applicable laws, including but not limited to copyright, privacy, and intellectual property laws.
8.2 We are not affiliated with SCS Software (the developers of ETS2 and ATS) and are not responsible for any consequences resulting from violations of their policies.

9. Termination and Suspension

9.1 We reserve the right to suspend or terminate service without prior notice if:

  • The server is used for illegal activities or violates applicable laws.
  • The server is found to be engaging in abusive network behavior (e.g., DDoS attacks, excessive resource consumption).
  • The customer fails to comply with these Terms and Conditions.

9.2 No refunds will be issued in the event of termination due to policy violations.

10. Disclaimer of Warranties

10.1 Our hosting services are provided on an “as-is” and “as-available” basis. We do not guarantee specific performance levels, uptime, or compatibility with all modifications.
10.2 We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

11.1 The customer agrees to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • The content, modifications, or software used on the hosted server.
  • The actions or behavior of users connected to the server.
  • Any legal or regulatory violations resulting from the server’s operation.

12. Amendments and Updates

12.1 We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or notification to the customer.
12.2 Continued use of our services after any amendments constitutes acceptance of the revised terms.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Italy.
13.2 Any disputes arising from or related to these terms shall be resolved in the courts of Milan.

By using our services, you acknowledge and agree to these Terms and Conditions. If you do not agree, you must discontinue use of our hosting services immediately.
